Appellate

The Appellate Unit is responsible for representing the State on appeals from convictions obtained in Monmouth County Courts. This responsibility includes indictable convictions and juvenile adjudications appealed to the Superior Court-Appellate Division and the New Jersey Supreme Court as well as disorderly persons offenses and motor vehicle violations appealed to the Law Division or ultimately to the higher appellate courts. The appellate section researches the factual and legal issues presented, writes the brief arguing the State's position and appears on behalf of the State at oral arguments.

The Unit is also responsible for researching legal issues, drafting briefs in response to the defendants' arguments and appearing in court on behalf of the State to present its position on pre- and post-trial motions. When appropriate, victims, witnesses and police officers are contacted to clarify factual issues. The trial section of the office has the main responsibility to respond to any brief filed pre-trial or during the trial.

The Unit, which is comprised of assistant prosecutors and support staff, is also responsible for expungements petitions, civil discovery, Open Public Record Act requests, name changes and all facets of legal research.
